The divorce mediation process in MA is the fastest and lowest cost method for obtaining a divorce. The divorce mediation process begins with a phone call or email from one spouse or parent who is interested in setting up a free initial consultation. On the phone, our mediator will explain that in order to set up the free initial consultation, both parties must agree to participate. Mediation can’t happen without the agreement of both people to participate.
Sometimes, one spouse is more interested in mediation than the other one. We find that because the initial consultation is free and requires no commitment to actually mediate the divorce, both people often agree to just try it out and see how it goes. After meeting our mediator and learning about mediation, many couples conclude that mediation is a smart way to divorce.
The Free Initial Consultation
The divorce mediation process begins with a free initial consultation. Both parties come to our office and meet the mediator. The mediator explains what mediation is and answers any questions either person has. The mediator will also explain the process and requirements for obtaining an uncontested no-fault divorce in Massachusetts. At the end of the session, the mediator will tell both parties to think it over and call or email if they want to schedule a first divorce mediation session.
If one party lives out of state, we offer the ability to participate in a free initial consultation or divorce mediation sessions via speakerphone or Skype.
Divorce Mediation Meetings
Progress begins on day one. The divorce mediation process starts at the first mediation session. This typically focuses on substantive issues that need to be addressed in the divorce, like who stays in the marital home or what temporary support arrangements are needed. In cases that don’t involve children, you will be asked to bring financial documents to the first mediation session where property division and financial issues will be addressed. In most first mediation sessions with a couple, immediate issues that must be resolved are in fact resolved.
Many divorce mediation cases completely resolve in two to four sessions. More complex or highly disputed cases may take longer.
