The universe of divorce mediators includes attorneys, psychologists/psychiatrists, therapists, social workers and other “divorce professionals”. When looking for a divorce mediator, you should choose a mediator who is also an experienced divorce lawyer. Here’s why:
– As you go through mediation, your mediator will not be giving you legal advice. Your mediator will give you legal information, will answer your questions, generate options and brainstorm your matter. If your mediator has spent substantial time in divorce courtrooms, he or she will be far better equipped to answer questions you may have about what might happen in court.
– An experienced divorce mediator who is also a practicing divorce attorney will have a unique understanding of what judges do that non-attorneys simply don’t have. All Massachusetts mediated divorce agreements must meet a standard of “fair and reasonable” on the day you go into court. An experienced mediator who is also an experienced divorce lawyer is better equipped to create a divorce agreement that meets the standard of fair and reasonable because that attorney knows how judges evaluate divorce agreements. It does you no good to spend valuable time and money mediating a divorce agreement that no judge will accept.

Attorney Claudia Bolgen graduated magna cum laude from Boston College Law School in 1990. After practicing for four years with the Boston law firm of Ropes & Gray, she began her appellate practice specializing in criminal law and family law appeals in 1994. In 2001, the Committee for Public Counsel Services presented her with the Mary C. Fitzpatrick Children and Family Law Award. In December 2008, she was named a 2008 Lawyer of the Year by Massachusetts Lawyers Weekly.
